A Year In Review – Litigation

And just like that, another 12 months pass since I was sat in this same situation, mulling over what has happened in both the costs world, and also that of the Paramount Legal Costs’ Litigation Department. 

I’ll start with training, as this was actually where I ended last year’s review, so it feels apt to follow on here.  We have delivered numerous in-house and remote costs training sessions spanning the length and breadth of the country.  Behind the scenes, we have been working hard to produce a number of exciting new training offers, and there will soon be a menu available for practitioners so they can choose specific topics where they would like to learn more.  We appreciate that every firm and department are different, and some may have a wealth of knowledge or experience in a certain area, whereas it may be newer to others.  That’s where we can come in and help, as costs law constantly changes, and it is good to stay up to date with the developments. 

We also took part in our first costs mediation, which was an interesting experience.  We were able to reach an amicable resolution which is obviously positive news, but I still do have some reservations about its role in every costs disputes, and I would be wary about it being a mandatory step prior to a detailed assessment. 

Fixed Recoverable Costs still rumbles on, particularly those relating to clinical negligence cases.  We are seeing the impact of some of the reforms that have been introduced, and will keep monitoring these as we go forwards. 

When looking at topical costs areas on the horizon, one firmly in my sight is that relating to fees of medical agencies, as it feels as though there are different decisions almost on a weekly basis – it is certainly a thought provoking area when you look at the different views, and also who will pick up the cost? 

Finishing with developments closer to home, it has been a privilege to work alongside members of the team and see them grow and take on new responsibilities.  This then enhances our clients’ experience of working with us, and Paramount’s already excellent reputation within the costs world.
